What Information We Collect

Unregistered users
Visitors to our website can browse some areas of the site, without disclosing any personally identifiable information. We do track information provided to us by your browser, including the website you came from (known as the "referring URL"), the type of browser you use and the date and time of access. Nursery Depot also logs your Internet Protocol (IP) Address. An IP address is a number that is automatically assigned to your PC every time you browse the Internet. Information from IP addresses is used for system administration, to examine overall traffic trends, troubleshooting, etc. This information is used only in the aggregate form. IP addresses are not linked to any personally identifiable information, meaning the user session is tracked but the user remains anonymous.
Registered users
In order to make purchases and receive mailings we optionally ask users to register. The following information may be required for registration: first and last name, e-mail address, and password. You will also have the capability to opt-in or out of receiving Nursery Depot's mailings and mailings from partners and affiliates of Nursery Depot.
Making a purchase
To make a purchase on Nursery Depot, we require that you provide, in addition to you registering information, your shipping and billing address (if they differ), phone number and credit card information (if paying by credit card). This information is stored in a secured database, only accessible to employees with access rights to this information. Protecting your information is a priority. Nursery Depot makes every effort to protect your online order and account information using Secure Sockets Layer (SSL) technology.
SSL encrypts your information to avoid the decoding of it by anyone other than Nursery Depot. Nursery Depot Employees
Nursery Depot employees are required to keep customer information private, as a condition of their employment with the company. Only selected, authorized Nursery Depot employees are permitted to access your information. All employees and contractors must abide by our privacy policy, and those who violate that policy are subject to disciplinary action, up to and including termination of their employment and legal action.

Indemnification

You, as a member of Nursery Depot, are entirely responsible for maintaining the confidentiality of your password and account and for all activities that occur under your account. Uses of Information

Aggregate Data
Nursery Depot creates aggregate data about visitors for product development and improvement activities. We also use it for market analysis. We may provide information from our website in aggregate form, with identifying information removed, to third parties. For example, we may tell a partner what percentage of our registered users resides in a particular geographical area. When aggregated information is provided, we pool it from many individual records and strip it of any data that could be used to identify an individual before it is used.
Third Parties
During the registration process, you will have the option to participate in third party mailings. If you opt-in to receive information from Nursery Depot and its partners and affiliates, your first and last name and postal address may be shared with those third parties. If you opt-in to receive mailings from Nursery Depot only or opt-out entirely, your information will not be shared with third parties.
If we discover that a third party inadvertently disclosed personal information about any of our customers, we will take immediate action to prevent further occurrences.
Other than the cases described above, Nursery Depot will not release personally identifiable information to a third party without the customer's consent.
If you no longer wish to receive future third party mailings, you can unsubscribe by sending us an e-mail to optout@nurserydepot.com with "no third parties" in the subject line. Order Acceptance and Shipment

Pricing and Sales Tax

We cannot confirm the price of an item until you place an order. We do not charge your credit card until your order is placed with the manufacturer. At the time that you place your order, it will include an estimate for sales tax; the actual amount will be charged at the time your order is shipped. We will add sales tax for orders to be delivered to addresses in the New York. Each customer is solely responsible for all sales/use taxes applicable to orders shipped to all other locations. The sales tax we charge will incorporate both state and local taxes and therefore may vary from one locale to another. It will be calculated based on state and local laws, which may include tax on shipping, handling, and gift-wrap charges. No sales tax is applied to gift certificates, but purchases paid for with gift certificates may be subject to tax.
